In court filings Monday, NASCAR said they have a ‘significant number’ of witnesses who can testify that they saw Mayfield using the same drug that NASCAR said they tested him positive for but that the former driver denies taking.
Mayfield and NASCAR have been in and out of court since NASCAR suspended him for a positive drug test. Mayfield sought and won and injunction to be reinstated only to have NASCAR win an appeal to have him suspended again.
NASCAR also disputed the timeline of another test that Mayfield delayed for nearly eight hours. Mayfield denied that he delayed the test while NASCR said it could prove that he did.
Among the witnesses NASCAR has is Mayfield’s former stepmother, who said in an affidavit that she personally saw him manufacture and use meth on many occasions.
It’s widely believed that among the witnesses that will testify against Mayfield is a former crewmember for his team, Paul Chodora, who was suspended by NASCAR in February for a positive drug test. There is a possibility that his testimony could include statements that he used meth with Mayfield.
At the time of Chodora’s suspension Mayfield’s organization fired him then released a statement saying “We as an organization appreciate NASCAR’s drug testing policies and policing efforts as it makes the sport stronger overall. If Paul doesn’t comply with NASCAR’s reinstatement process, then he will no longer be an employee of Mayfield Motorsports.”
Also Monday, Mayfield’s defense team said they continue to refuse having their client tested at an independent lab.
